- [00:00:14.248]criminal history background check, you have been charged
- [00:00:17.684]or ticketed with committing an illegal act
- [00:00:20.354]that could have led to a misdemeanor
- [00:00:21.955]or felony conviction, but you were never convicted
- [00:00:24.224]of that act. This means that the charges
- [00:00:26.660]were dismissed, you were found not guilty,
- [00:00:29.296]or you completed diversion.
- [00:00:31.231]Your criminal history may show
- [00:00:32.732]how the charge or charges were disposed of.
- [00:00:35.636]Please review your background check
- [00:00:37.070]to make sure the information provided is accurate.
- [00:00:40.607]After five to seven years, it is possible that charges
- [00:00:43.143]no longer appear on a background check.
- [00:00:46.380]This does not mean that the charges have disappeared;
- [00:00:49.349]rather the court system no longer actively posts
- [00:00:51.652]a criminal history if there were only charges.
- [00:00:54.721]Most importantly, it means that you were never convicted.
- [00:00:57.691]Please note that we are not considering traffic violations
- [00:01:00.527]such as speeding tickets, but only charges that could have led
- [00:01:03.297]to a misdemeanor or felony conviction.
- [00:01:06.266]If you have been charged or ticketed
- [00:01:07.968]but you were never found guilty of a misdemeanor
- [00:01:10.103]or felony conviction, you are approved to either apply for
- [00:01:13.340]or continue on in your program at UNL.
- [00:01:16.576]In addition, you will
- [00:01:17.611]not have any problems
- [00:01:18.779]with getting certified through
- [00:01:20.180]the Nebraska Dept. of Education
- [00:01:22.049]related to a background check.
- [00:01:23.684]However, some school districts
- [00:01:25.118]ask on their application forms if candidates have ever been
- [00:01:28.288]charged with any crime. These charges may include
- [00:01:30.757]traffic violations.
- [00:01:32.693]If you have been charged,
- [00:01:33.794]it is their position
- [00:01:34.661]that you must respond, yes,
- [00:01:36.463]to any questions tied to charges
- [00:01:38.298]and you may have to identify
- [00:01:40.067]each specific charge.
- [00:01:41.735]If you were aware of charges
- [00:01:43.337]that are not posted
- [00:01:44.438]on your background check,
- [00:01:45.839]you're still required
- [00:01:46.607]to disclose this information.
- [00:01:48.542]If you have been charged with or convicted of a crime
- [00:01:51.211]and you fail to report it on the application form,
- [00:01:53.547]even if the charge
- [00:01:54.648]was dismissed,
- [00:01:55.582]you were found not guilty
- [00:01:57.117]or you completed diversion,
- [00:01:58.785]or if you know
- [00:01:59.720]you have a charge somewhere
- [00:02:01.221]but the background check failed
- [00:02:02.255]to report the charge,
- [00:02:04.124]you may be removed
- [00:02:04.791]from consideration
- [00:02:05.759]for a position
- [00:02:06.526]in that school system.
- [00:02:08.362]To avoid this situation,
- [00:02:09.395]human resources professionals believe that you
- [00:02:11.565]must make full disclosure of any and all charges.
- [00:02:15.235]If you have questions concerning the completion
- [00:02:17.204]of an application, make sure you ask someone
- [00:02:19.606]in Human Resources in that specific school system
- [00:02:22.743]about how you should respond. They may want you to list
- [00:02:25.646]any charge including traffic violations,
- [00:02:28.181]so be prepared to respond appropriately.
- [00:02:30.484]Students are strongly encouraged to read
- [00:02:32.519]the Professional and Ethical Behavior section
- [00:02:34.621]found in the Undergraduate Bulletin
- [00:02:36.523]under the College of Education and Human Sciences.
- [00:02:39.393]If you are convicted of a felony or misdemeanor
- [00:02:41.528]after the completion of your first background check
- [00:02:44.498]and while you are a student in a UNL program,
- [00:02:46.933]you are required to contact
- [00:02:48.835]either the College's Director of Professional Experiences
- [00:02:51.972]or the Certification Officer, immediately.
- [00:02:55.075]Contact information is listed on the CEHS website.
- [00:02:58.478]Failure to disclose any new convictions
- [00:03:01.181]could place you in violation of the Professional
- [00:03:03.216]and Ethical Behavior code of conduct and may lead to removal
- [00:03:06.953]from the program.
