- [00:00:28.613]certified seed, and that process,
- [00:00:30.700]so we'll get his Powerpoint switched over here.
- [00:00:33.310]Some of you might be wondering
- [00:00:34.210]why we're talking about selling seed
- [00:00:35.650]at a cover crop meeting.
- [00:00:37.740]Well, growers have been planting cover crops
- [00:00:40.290]since they've become a hot topic,
- [00:00:42.420]and they plant them, and plan to terminate them
- [00:00:46.020]until they walk out in their field and go,
- [00:00:47.557]"Wow, this is a great stand."
- [00:00:50.350]Then, they rationalize, "Well, I'll let it mature,"
- [00:00:53.212]"and I'll harvest it for seed, and then I'll have"
- [00:00:56.367]"my seed for cover crop next year,"
- [00:00:58.947]"and maybe the neighbor might wanna buy some,"
- [00:01:02.760]and that's where they get in trouble
- [00:01:04.710]because selling seed in Nebraska
- [00:01:06.910]is not that easy.
- [00:01:08.160]Selling seed in any other states, not that easy either,
- [00:01:12.380]so what do we need to be concerned about?
- [00:01:15.150]First, we need to know what we planted.
- [00:01:18.370]You should receive a tag with your seed,
- [00:01:20.880]either an analysis tag, or a certified seed tag,
- [00:01:24.840]that way, you would know whether that seed
- [00:01:26.810]is protected or not.
- [00:01:29.140]If you don't get a tag with your seed,
- [00:01:32.323]you better be asking who's selling that seed, for one,
- [00:01:35.910]because then, you know you're getting legal seed, for sure.
- [00:01:41.230]Then, you need to know if it's protected.
- [00:01:42.940]If you get a certified tag with it,
- [00:01:44.900]basically, it'll say on there how it is protected.
- [00:01:50.900]Generally, PVP or patent is the way
- [00:01:53.728]crop seeds are protected.
- [00:01:57.540]Soybean seeds generally have both a patent,
- [00:02:00.530]or a PVP, or both.
- [00:02:03.370]Most of the small grains are protected by PVP.
- [00:02:07.830]So a lot of times, you're using small grains
- [00:02:10.160]for your cover crops.
- [00:02:12.129]If you do buy a protected variety,
- [00:02:15.630]you cannot sell farm-saved seed, a PVP protected variety.
- [00:02:22.599]You can't purchase a protected variety as grain,
- [00:02:27.550]and sell it as seed, and even the conditioner,
- [00:02:31.730]if you take it to somebody to have it conditioned,
- [00:02:35.400]he can only condition the amount that you can plant
- [00:02:38.970]on your seed.
- [00:02:39.970]PVP does have a provision that you can save enough seed
- [00:02:44.030]to plant on your own holdings.
- [00:02:50.490]Now, the state of Nebraska has two provisions
- [00:02:53.460]that you need to follow for selling seed.
- [00:02:56.790]First, you need a seed permit.
- [00:03:00.010]The second is the seed needs to be tested
- [00:03:02.200]and labeled correctly.
- [00:03:07.050]Getting the permit is pretty easy.
- [00:03:08.790]You can go to the website up there,
- [00:03:11.380]and you can find this form, and you can print it out,
- [00:03:14.740]and fill it out, and send a check to the Department of Ag.
- [00:03:18.800]You can see there's different levels of seed
- [00:03:21.119]produced here in different amounts.
- [00:03:24.020]For the fee due, you can send that in
- [00:03:26.570]to the Department of Ag, and they will send you
- [00:03:29.222]a permit that looks something like that,
- [00:03:32.790]and that's a permit to sell seed.
- [00:03:35.571]You need to post that someplace where people can see
- [00:03:37.800]that you're allowed to sell seed.
- [00:03:44.540]The next provision is, this is a statute
- [00:03:47.550]in the seed law that requires it to be tested and labeled,
- [00:03:53.330]and basically, on the label, you need
- [00:03:56.710]the name of the labeler, the variety name, if you know it,
- [00:04:00.770]or VNS, variety not stated.
- [00:04:04.600]You need the percent pure seed, the germination percent,
- [00:04:08.740]and the noxious weed seed percent.
- [00:04:14.220]This is what an analysis tag looks like
- [00:04:17.080]that we print for some of our growers
- [00:04:19.760]at Nebraska Crop Improvement Association.
- [00:04:21.940]It has all the official information on there
- [00:04:25.070]that you need to sell seed, so if an inspector
- [00:04:29.090]stops by your place from the Department of Ag,
- [00:04:31.500]and they are out there, looking at places
- [00:04:33.700]that sell seed, and making sure that they have permits,
- [00:04:37.270]and that they have labeled their seed,
- [00:04:40.630]so this is what it looks like.
- [00:04:43.360]So how do you go about that?
- [00:04:45.050]Well, Nebraska Crop Improvement established a seed lab
- [00:04:49.210]in 1941, and in 1950,
- [00:04:53.460]the Association of Official Seed Analysts
- [00:04:58.320]approved our lab for testing,
- [00:05:01.190]and the Nebraska Crop Improvement and Seed Lab
- [00:05:03.900]is the only lab in Nebraska that is official testing lab
- [00:05:08.948]for labeling seed.
- [00:05:12.150]So how do you get there?
- [00:05:14.190]Well, there's our website for our,
- [00:05:15.958]or the address for our website.
- [00:05:20.710]You can go on there, and we have the lab fees
- [00:05:27.010]for how much is testing, how much you need to send,
- [00:05:30.960]and there's also a form located on there
- [00:05:32.890]that you can fill out, and send the sample in,
- [00:05:36.900]and basically, like I said, you need
- [00:05:38.930]purity, germ, and noxious.
- [00:05:41.290]Now, I have brought some seed laws
- [00:05:43.270]back there on the table.
- [00:05:44.320]They're in a nice yellow book,
- [00:05:45.910]if you're interested in reading up on it,
- [00:05:47.930]or you can actually go to the NDA website,
- [00:05:51.870]and Google, or Google seed law, and it'll take you right,
- [00:05:55.370]Nebraska seed law, and it'll take you
- [00:05:56.960]right to that online form, so with that,

- [00:06:09.760]I will say I worked with a grower in Dodge County,
- [00:06:11.900]on rye, and really, the permit and the sending the seed in,
- [00:06:14.750]it's fairy inexpensive, and fairly easy,
- [00:06:18.030]so, I guess, don't let the process scare you.

- [00:06:34.490]do you label variety if it's not,
- [00:06:38.870]if I know what the variety is,
- [00:06:40.460]but I'm not replanting a certified seed?
