[00:01:13.470]Prior to digging into an additional analysis,
[00:01:17.060]re-read the project description,
[00:01:19.010]and remember the NDOT activities
[00:01:21.350]more likely to have impacts,
[00:01:23.480]which include projects with right-of-way acquisition,
[00:01:27.240]easements, or displacements,
[00:01:29.650]projects with structure removal or modification,
[00:01:33.400]underground utility or pipeline work,
[00:01:36.520]installation of columns or piers,
[00:01:39.820]soil disturbance or excavations greater than five feet deep,
[00:01:44.890]grading in urbanized areas,
[00:01:47.860]construction of foundations for new or relocated lighting
[00:01:52.200]or traffic signals or overhead signs.
[00:01:55.780]Projects with these types of activities
[00:01:57.590]may require more robust additional analysis.
[00:02:02.390]Research the regulatory files for sites
[00:02:04.770]with leaking underground storage tanks,
[00:02:07.770]release assessments,

[00:02:52.400]assess records for whether contamination was found
[00:02:55.500]and what was identified.

[00:04:07.610]When reviewing regulatory files,
[00:04:09.720]it may be important to note the concentration
[00:04:12.140]of contaminants of concern,
[00:04:14.370]whether or not they are below, meet, or exceed state
[00:04:18.930]and/or federal regulatory thresholds and standards.
[00:04:23.420]The scope of work, plan construction methods,
[00:04:26.740]or other potential impacts of the project may be affected
[00:04:29.900]by the regulatory implications of working in an area
[00:04:33.490]with contamination over risk-based screening levels
[00:04:37.300]or maximum contaminant levels.
[00:04:40.980]When coordinating with NDOT Haz Mat PQS
[00:04:44.300]on findings of the HMR report, the information contained
[00:04:47.970]in the regulatory file informs their decision
[00:04:50.700]to coordinate with NDEE, if necessary,

[00:04:57.120]and providing appropriate direction.
[00:05:00.430]When reviewing regulatory files,
[00:05:02.690]site diagrams often show buildings, locations of wells,

[00:05:14.980]This information is considered a pertinent file
[00:05:18.560]and should be saved and presented
[00:05:20.470]with the HMR report attachments.

[00:05:27.120]to evaluating where the contamination has migrated
[00:05:30.380]in relation to the project site.
[00:05:33.030]Plumes may extend great distances
[00:05:35.090]and extend miles from their point of origin.

[00:05:40.340]if there could potentially be concerns
[00:05:42.600]within the project footprint.
[00:05:45.290]Site closure documentation depends on the regulatory program
[00:05:49.440]under which the facility remediation falls.
[00:05:52.920]Types of closure documents include
[00:05:55.070]but are not limited to No Further Action letters,
[00:05:59.420]tank closure reports,
[00:06:01.650]Records of Decision,
[00:06:03.350]and No Further Remedial Action Planned documents.
[00:06:09.360]Though a site may be closed
[00:06:10.870]under the regulatory program oversight,
[00:06:13.290]there may still be residual contamination,
[00:06:15.830]which should be considered for determining potential impact
[00:06:18.710]to risks or to project delivery.
[00:06:21.890]This Casey's General Store
[00:06:23.780]was the site of a former gas station
[00:06:25.640]which had an underground leaking storage tank.
[00:06:29.090]The site is closed,
[00:06:30.650]that is, no further remedial action is needed,
[00:06:33.740]but minimal contamination still exists.
[00:06:37.970]Historical aerial photographs,
[00:06:40.330]USGS historical topographic maps,
[00:06:43.610]and Sanborn Fire Insurance Maps are researched
[00:06:46.920]because they show previous uses of the HazMat site,
[00:06:50.810]or they may show the dates the property was purchased
[00:06:53.960]by a HazMat-producing company.
[00:06:58.530]Historical land uses can also be found
[00:07:00.620]in comprehensive plans and long-range transportation plans.
[00:07:05.140]Remember, HazMat sites are more common
[00:07:08.160]in commercial or industrial areas,
[00:07:11.040]historic landfills, missile silos,
[00:07:14.500]USDA grain bins, and railroad properties.
[00:07:20.630]Wrapping up lesson two, we discussed methods to use
[00:07:23.970]to determine if contamination still exists
[00:07:26.770]at identified HazMat sites,
[00:07:29.160]the depth of the contamination,
[00:07:31.380]and whether or not the contamination
[00:07:33.190]is above threshold levels.
[00:07:36.790]The objective of lesson three is for participants to learn
[00:07:40.810]when to use specific mitigation measures.
[00:07:44.900]Mitigation measures are a means to prevent, reduce,
[00:07:48.420]or control adverse environmental effects of a project
[00:07:52.430]and include restitution for any damage
[00:07:54.530]to the environment caused by those effects
[00:07:57.000]through replacement, restoration, compensation,
[00:08:01.070]or any other means.
[00:08:03.410]NEPA requires mitigation to avoid or minimize impacts
[00:08:08.090]to the human and natural environment.
[00:08:11.940]Project-specific mitigation measures may include
[00:08:15.520]materials management plans,
[00:08:17.960]health and safety precautions,
[00:08:20.430]groundwater monitoring wells,
[00:08:22.810]and demolition-related considerations
[00:08:25.290]for asbestos-containing material, lead-based paint,
[00:08:29.890]or polychlorinated biphenyls, or PCBs.
[00:08:35.600]NDOT's standard mitigation for unexpected waste
[00:08:39.860]used for all projects is the following.
[00:08:43.130]If contaminated soils or water
[00:08:45.130]or unexpected wastes are discovered,
[00:08:47.960]the contractor shall stop all work
[00:08:50.690]within the immediate area.
[00:08:53.120]The contractor shall secure the area of the discovery
[00:08:57.090]and notify the NDOT Construction Project Manager, or CPM.
[00:09:03.010]The contractor shall not re-enter the discovery area
[00:09:06.390]until allowed to do so by the CPM.
[00:09:10.230]At the time of discovery, the CPM and contractor
[00:09:13.810]shall utilize the NDOT Unexpected Waste Action Plan
[00:09:18.490]to coordinate appropriate actions.
[00:09:21.620]The actions to be carried out by the NDOT CPM are,
[00:09:26.010]but not limited to,
[00:09:28.090]verification that the contractor has suspended
[00:09:31.110]construction activities in the area of discovery,
[00:09:34.230]and contact the Environmental Section Manager
[00:09:37.990]and make an entry into Site Manager
[00:09:40.600]that an unexpected waste discovery was made.
[00:09:44.930]The CPM shall then utilize the Unexpected Waste Action Plan,
[00:09:49.670]or UWAP, Site Discovery Checklist
[00:09:53.350]to properly document the extent and type of waste.
[00:09:57.590]The CPM shall ensure that proper disposal of the waste
[00:10:01.090]and any required health and safety mitigation is implemented
[00:10:04.400]by the contractor.
[00:10:06.620]The contractor is required
[00:10:07.900]by NDOT's Standard Specification 107,
[00:10:11.690]Legal Relations and Responsibilities to the Public,
[00:10:15.420]to handle and dispose of regulated material
[00:10:18.720]in accordance with applicable laws.
[00:10:24.310]Standard mitigation is used
[00:10:25.860]to provide a consistent program-wide methodology
[00:10:29.210]for implementing due diligence regarding HazMat concerns.
[00:10:33.660]It also defines expectations of contractors
[00:10:36.470]in the field during construction.
[00:10:39.030]During the NEPA process,
[00:10:40.810]NDOT Environmental and the consultant coordinate
[00:10:44.610]with the project roadway and bridge designers
[00:10:47.280]to communicate potential hazardous material locations,
[00:10:50.660]concerns, or conflicts through the established
[00:10:54.080]Project Coordination Meeting, or PCM, process.
[00:10:58.730]NDOT Environmental and Design staffs
[00:11:01.300]coordinate various environmental concerns
[00:11:03.940]at the PCM meetings throughout the design process
[00:11:07.610]depending on the type and complexity of the project.
[00:11:11.570]Potential hazardous material concerns or conflicts
[00:11:14.730]and mitigation measures will be addressed and identified
[00:11:18.020]on design plans, various design reports,
[00:11:21.530]such as the Plan-in-Hand Report or PCM meeting minutes,
[00:11:25.700]as well as HMR reports, NEPA documents, and Green Sheets.
[00:11:31.790]Following the completion of an HMR during NEPA,
[00:11:35.560]NDOT also revisits the HMR findings
[00:11:38.830]during later preliminary and final design phases
[00:11:42.120]to ensure that hazardous materials concerns discovered
[00:11:45.630]early during the planning phases have been considered
[00:11:49.280]and carried forward into design and construction.
[00:11:54.290]For some projects,
[00:11:55.480]the findings of the HMR may have prompted NDOT
[00:11:58.590]to authorize a subsurface investigation
[00:12:01.590]during the NEPA process.
[00:12:03.820]The timing of the subsurface investigation would occur
[00:12:06.800]prior to NEPA clearance.
[00:12:08.910]However, recommendations based on the outcome
[00:12:11.610]of the subsurface investigation may be carried forward
[00:12:15.170]as commitments or mitigation measures.
[00:12:19.030]The investigation may have identified sites
[00:12:22.030]along a project corridor
[00:12:23.430]that require waste characterization,
[00:12:25.660]special provisions for handling,
[00:12:27.740]and disposal or reuse options.
[00:12:31.320]Guidance for materials management
[00:12:33.570]and proper disposal may be found in NDEE's
[00:12:37.787]"Investigation-Derived Waste

[00:12:48.120]As cited in that guidance document,
[00:12:50.750]material "generated at a site that is not a remediation
[00:12:54.867]"or investigation activity site are not considered a waste
[00:12:59.337]"unless it is intended for disposal."
[00:13:02.550]If materials such as soil or groundwater which are known
[00:13:05.920]or suspected of being contaminated will be taken off site,
[00:13:09.710]then the contractor is required
[00:13:11.560]to treat it as a special waste
[00:13:13.530]and follow NDEE regulations for proper disposal.
[00:13:18.900]The materials management plan should include provisions
[00:13:21.350]and protocols to containerize the waste materials
[00:13:25.550]and to characterize it for proper management
[00:13:28.100]and final disposal.
[00:13:31.210]Prior to the start of construction activities,
[00:13:33.830]a preconstruction conference will be held as required
[00:13:36.750]by Section 103.01 of the "NDOT Construction Manual."
[00:13:42.420]The purpose of the meeting is
[00:13:43.700]to discuss pertinent information to the project
[00:13:46.720]before construction begins,
[00:13:48.500]including hazardous materials reviews
[00:13:50.970]and health and safety issues.
[00:13:53.070]Procedures on what to do
[00:13:54.750]if unexpected waste is encountered would be discussed.
[00:13:58.920]Worker notification is also required,
[00:14:01.340]particularly if the potential to encounter contamination
[00:14:04.610]is expected in the work area
[00:14:06.860]that addresses the specific concern identified
[00:14:09.580]within the work area.
[00:14:11.610]Review Risk-Based Screening Levels, or RSBLs,
[00:14:16.000]as promulgated by NDEE.
[00:14:19.230]Also, coordinate with Department of Health
[00:14:21.830]and Human Safety Services
[00:14:23.280]to determine contamination exposure levels
[00:14:26.440]for health and safety mitigation.
[00:14:29.240]Requirements related to actions
[00:14:30.900]to be taken if hazardous materials are encountered
[00:14:33.180]during construction are located in Section 107.01
[00:14:38.220]of the "Standard Specifications for Highway Construction"
[00:14:41.000]and are applicable during the construction of this project.
[00:14:46.280]There are three demolition-related considerations
[00:14:49.260]when conducting the HMR process.
[00:14:52.120]These are asbestos-containing material,
[00:14:55.680]lead-based paint,
[00:14:57.320]and polychlorinated biphenyls, or PCBs.
[00:15:03.260]The asbestos-containing materials, or ACM, investigation
[00:15:08.460]can occur anytime during project planning
[00:15:11.070]but must occur prior to the demolition of any structures
[00:15:14.920]and can be the responsibility of the contractor.
[00:15:18.630]ACM investigations may be necessary
[00:15:21.030]for a variety of reasons,
[00:15:22.920]including but not limited to structure modification,
[00:15:26.940]demolition, and/or repairs.
[00:15:29.870]Most often, structures are bridges for NDOT work.
[00:15:33.870]However, sometimes it may involve other structure types,
[00:15:37.000]such as buildings.
[00:15:38.930]Due to the various bridge repairs
[00:15:41.010]that could warrant an asbestos survey,
[00:15:43.300]note that if a bridge is being widened, re-decked, replaced,
[00:15:48.430]or a structure is being demolished,
[00:15:50.750]an ACM survey will need to be completed
[00:15:53.110]by a licensed inspector.
[00:15:55.790]NDOT will make the determination for the need
[00:15:58.420]prior to completion of the HMR.
[00:16:01.360]Coordinate with the NDOT PQS
[00:16:04.680]if this comes up on your project.
[00:16:07.730]Be aware there will be other instances

[00:16:14.400]During the visual reconnaissance,

[00:16:57.670]and rail updated with lead shims.

[00:17:03.600]with lead paint on them.
[00:17:06.920]During the project visual reconnaissance,
[00:17:09.090]the EP should note the presence
[00:17:11.050]of any potential polychlorinated biphenyl
[00:17:14.760]or PCB-containing transformers
[00:17:17.730]and document in the photo log.
[00:17:20.140]This equipment can be identified
[00:17:21.640]by PCB containing blue stickers
[00:17:25.020]that say either No PCBs
[00:17:28.270]or PCB-free.
[00:17:31.330]If the PCB-containing transformers
[00:17:33.930]or other equipment is suspected to be present,
[00:17:36.980]NDOT requires they be managed and disposed of
[00:17:40.290]according to the Toxic Substance Control Act regulations
[00:17:44.390]in coordination with EPA.
[00:17:47.540]The utility owner is responsible for transformer equipment,
[00:17:51.270]including those that are PCB-containing,
[00:17:54.000]and would be responsible for maintaining
[00:17:55.930]and/or replacing equipment with PCB-free equipment.
[00:18:01.780]Any electrical equipment with no label
[00:18:04.020]or unknown concentration is assumed
[00:18:06.630]to be PCB-contaminated equipment per EPA regulations
[00:18:12.100]and should be managed by the utility company accordingly.
[00:18:16.720]Only include mitigation language in the HMR
[00:18:20.190]if PCB-containing electronic transformer utilities
[00:18:24.280]are proposed to be relocated as part of the project.
[00:18:30.100]Wells are identified by performing a review
[00:18:32.790]of the Registered Wells Database

[00:18:39.240]However, only wells that can be identified
[00:18:42.170]from public right of way are typically captured
[00:18:45.000]during the visual reconnaissance.
[00:18:47.360]Document them in the photo log.
[00:18:50.870]If there are wells within the project footprint,
[00:18:53.310]ask if the wells can be avoided.
[00:18:55.800]And if the answer is yes,
[00:18:58.090]they will be marked on the plans as Do Not Disturb.

[00:19:05.360]the next question is are they active?
[00:19:08.990]If they are active, are they part of an ongoing remediation,

[00:19:40.690]is necessary to ensure the proper application
[00:19:43.640]of mitigation measures.
[00:19:45.900]At times, this coordination is the PQS review
[00:19:49.910]of the HMR report to verify findings
[00:19:53.120]and recommendations for mitigation.
[00:19:56.910]The objective of lesson four will help participants
[00:20:00.090]understand who NDOT considers qualified to conduct HMRs.
[00:20:05.910]Participants will also be taught common oversights
[00:20:09.220]when conducting a review.
[00:20:12.640]HMRs must be completed
[00:20:14.820]or overseen by someone meeting the qualifications
[00:20:17.920]of an Environmental Professional.
[00:20:20.170]This requirement applies to all NDOT
[00:20:22.480]and consultant staff conducting HMRs.
[00:20:26.100]These qualifications are
[00:20:28.820]a person with a bachelor's or higher degree
[00:20:31.300]from an accredited institution of higher education
[00:20:34.400]in a discipline of engineering or science
[00:20:36.910]that has the equivalent of three years
[00:20:39.220]of full-time relevant experience
[00:20:41.210]and has obtained a certificate
[00:20:43.920]from a training course specific to hazardous materials,
[00:20:47.040]such as but not limited to
[00:20:49.640]Hazardous Waste Operations and Emergency Response
[00:20:53.730]or ASTM Environmental Site Assessment Standard Practices
[00:20:57.720]for the Phase I or Phase II Site Assessment.
[00:21:01.460]A person who does not hold a certificate
[00:21:03.620]from a training course may still qualify as an EP
[00:21:06.650]if he or she has a bachelor's or higher degree
[00:21:09.840]from an accredited institution of higher education
[00:21:12.700]in a discipline of engineering or science
[00:21:15.010]and has the equivalent
[00:21:16.240]of three years' full-time relevant experience
[00:21:18.890]and has studied under a senior professional engineer
[00:21:22.410]or scientist that has the equivalent
[00:21:24.600]of seven years' experience
[00:21:26.520]in conducting HMRs for NDOT.
[00:21:30.690]Junior staff can conduct an HMR
[00:21:33.240]under the supervision of an EP,
[00:21:35.590]including quality control review by an EP.
[00:21:39.730]EPs must complete the NDOT HMR web training
[00:21:44.060]and must show proof of completion
[00:21:45.980]in order to be considered pre-qualified
[00:21:48.570]to do NDOT HMR work.
[00:21:52.900]Prior to submitting the HMR to NDOT, the consultant must
[00:21:56.940]complete their own quality control process.
[00:22:00.610]Documentation of the quality control completed for the HMR
[00:22:04.130]is submitted with the report to the PQS
[00:22:08.360]and a record kept with the project file.
[00:22:11.770]Here's an example of tracking quality control in a form.
[00:22:17.870]When conducting an HMR, there are several potential areas
[00:22:21.210]that may be overlooked or misinterpreted.
[00:22:23.850]These might include the shelf life
[00:22:25.740]of the information obtained for the HMR,
[00:22:28.900]data gaps or failures,
[00:22:31.070]assessment search distance,
[00:22:33.070]historical information search intervals,
[00:22:35.800]changes in regulations,
[00:22:37.770]and general learning curve
[00:22:39.210]or experience-related observations
[00:22:41.470]during visual reconnaissance activities.
[00:22:45.100]For data gaps,
[00:22:47.150]search intervals of every five years may be necessary
[00:22:51.080]if there's been a lot of change.
[00:22:53.361]A search interval of every 10 years is acceptable
[00:22:56.530]if property use has not changed much.
[00:22:59.520]More than 10 is acceptable if the property use
[00:23:02.490]has not changed over a longer period of time,
[00:23:04.680]such as agricultural farm land
[00:23:06.930]that has been farmed since 1920 through 1970
[00:23:11.100]or a building that has the same use
[00:23:13.370]in a 1915 Sanborn Fire Insurance Map
[00:23:17.550]as in the 1955 map.
[00:23:20.760]It's also important to know changes in regulations.
[00:23:24.350]Prior to regulations,
[00:23:26.180]records for registered tanks or wells may not be available.
[00:23:30.810]When interviews are not conducted or a historical resource,
[00:23:34.270]such as Sanborn Fire Insurance Maps,
[00:23:37.660]is not reviewed, it is a data gap.
[00:23:42.200]For data failure,
[00:23:44.100]when historical resources are unobtainable,
[00:23:47.100]this is a data failure.
[00:23:49.430]Information from resources that could not be reviewed
[00:23:52.170]or obtained could be considered a data failure.
[00:23:57.530]In lesson four,
[00:23:58.430]we discussed who is qualified to do an HMR.
[00:24:02.430]We emphasized quality control is required
[00:24:05.510]and discussed common oversights resulting in data gaps
[00:24:09.050]and data failures.

[00:24:31.220]the guidance document includes a template to follow.
[00:24:34.880]The primary sections included in the HMR include
[00:24:38.550]a brief project description, environmental setting,
[00:24:42.690]database results, visual reconnaissance observations,
[00:24:47.720]if applicable, additional analysis summary
[00:24:50.700]and subsurface investigation results,
[00:24:54.280]and a summary of the findings,
[00:24:56.290]the mitigation measures to be carried forward
[00:24:58.930]in the NEPA document and Green Sheets,
[00:25:01.360]and, finally, references.
[00:25:05.960]Attachments to the HMR report need to include
[00:25:09.580]a vicinity map or project on a topographic map,
[00:25:13.830]a location map showing the HMR study area
[00:25:16.550]on recent aerial photography,
[00:25:19.360]the full approved project description,
[00:25:22.650]photographs, if needed,
[00:25:24.060]to support the low, medium, or high determination,
[00:25:28.440]and any pertinent regulatory files, if applicable.
[00:25:34.410]The location maps should depict the HMR study area.
[00:25:38.810]Any identified sites discussed
[00:25:40.580]in the HMR narrative should be shown.
[00:25:43.750]The groundwater flow direction is
[00:25:45.910]to be indicated with a blue arrow.
[00:25:48.900]Several registered wells within the area

[00:26:06.940]of the HMR should be submitted to NDOT

[00:26:19.500]and request those files,
[00:26:21.010]sometimes years after the fact.

[00:26:26.040]for NDOT's project file include

[00:26:32.030]visual reconnaissance form, photo log,
[00:26:35.980]all pertinent regulatory file information,
[00:26:39.670]groundwater well search, if applicable,
[00:26:43.470]any historical resource records obtained,
[00:26:47.010]and a database report and search records.
